Please note that if we receive your “Opt-Out” correspondence after having shared your PII with a third party or transferred or otherwise disposed of it, the Company may not have any ability to control the use of such data by such third party, so you agree that the Company will have no responsibility or liability whatsoever as a result of the use of such data by such third party or such transfer or disposition. Therefore, if you are concerned about the Company sharing your PII with third parties or otherwise transferring or disposing your PII, you should consider not providing your PII to us.

Non-Personally Identifiable Information

In some cases, you may be requested to provide the Site with certain information about you that is not personally identifiable, such as your age, zip code, preferences or other personal characteristics or traits (“NPII”, and, together with your PII, “Your Information”). Public Forums

From time to time you may be able to participate in certain activities on the Site, such as chat rooms or bulletin boards, which will allow you the opportunity to communicate with us or other users of the Site. In addition, due to the open communication nature of the Internet, we cannot guarantee that communications between you and the Site will be free from unauthorized access by third parties. Users of the Site use it at their own risk.

In an attempt to enhance the experience and functionality of visiting the Site, we may choose to link the Site to various Linked Sites. We may have no control over the acts or omissions of these Linked Sites, and each will have its own privacy policy and data collection practices, independent of us and the Site. We have no liability or responsibility whatsoever for these Linked Sites or for their policies, practices and content. We provide these links for your convenience, and you link to these sites at your own risk.

IV. Children

We are concerned about the safety of children when they use the Internet. The Site is neither directed nor targeted to children under 13 years old. Consistent with the Children’s Online Privacy Protection Act of 1998, we have no intention knowingly to collect any PII from individuals under the age of thirteen (13) years. If we learn that a child under the age of 13 years has provided PII to the Site without verifiable parental consent, we will use commercially reasonable efforts to delete such information from our records. We strongly encourage parents to monitor their children’s use of the internet, and we will use our reasonable efforts to delete PII that we have inadvertently received from any under age 13 child as set forth above if a parent sends us a request as provided under Article VI below.

V. Contacting Us Regarding Your Personally Identifiable Information

Please note that we may share your PII with third parties, or otherwise transfer, sell, assign, dispose of or encumber your PII, prior to receiving your correspondence, and we will not undertake any effort to cause such third parties with whom we have shared your PII or to whom we have transferred, sold, assigned, disposed of or encumbered your PII, to delete or update your PII, so, if this concerns you, you should not share your PII with the Site.

VI. Opt-Out

If you (i) do not want to receive information as a result of your activity at the Site, (ii) do not want us to provide your PII to others or (iii) want us to delete any of your PII that you have submitted to the Site, please contact us or send a letter to the Senior Vice President-Corporate Communications, MacAndrews & Forbes Incorporated, 35 East 62nd Street, New York, New York 10065. Because information submitted in connection with employment inquiries is used only in the application process and not for marketing purposes, the procedures outlined in this section are not available with respect to such information.

Please note that once we receive your request, it may take some time to become effective (during which time we may continue to use your PII as outlined in this Privacy Policy). In addition, if you ask us to remove your PII from our records, we may still maintain your name of other PII in a “do not mail” file to help us ensure that we can honor your request. Also, if you do not want us to share your PII with third parties, or transfer, assign, sell, dispose of or encumber your PII, you must inform us separately if you want your PII deleted from our records. Otherwise, we will continue to have the right to use your PII as outlined in this Privacy Policy.

Additionally, please note that if we receive your email or other correspondence after having shared your PII with a third party, or after having transferred, sold, assigned, disposed of or encumbered your PII, we may not have any ability to control the use of such data by such third party (and we undertake no obligation to do so), so you agree that we will have no responsibility or liability whatsoever as a result of the use of such data by such third party. You also agree that we shall have no responsibility, obligation or liability to you for sharing your PII with third parties or from transferring, selling, assigning, disposing of or encumbering your PII prior to implementing your “Opt-Out” notification. Therefore, if you are concerned about having us share your PII with third parties, or transferring, selling, assigning, disposing of or encumbering your PII, you should not provide to us such information.

VII. Acceptance Of These Terms; Consent to Processing
